Hi, I’m Nelly Ariwi, an Advocate of the High Court of Kenya based in Nairobi with over 5 years of experience. Specializing in Data Protection and Privacy Laws, I bring a robust combination of policy formulation, project execution, compliance management, and global team collaboration to the table.

My expertise stretches across contract drafting, negotiation, and legal research, underpinned by strong analytical thinking and leadership abilities. Project Overview: In my capacity as a legal consultant based in Nairobi, Kenya, I was enlisted in June 2023 to resolve a breach of contract dispute between a client and their maintenance contractor. This case study details the methods and legal research from June 2023 to March 2024 that led to resolving the issue efficiently, avoiding costly litigation.

Challenge: Our client had fully paid Ksh. 10,000,000 to a contractor for vehicle and machinery maintenance. Despite this, the client’s equipment failed shortly thereafter. The contractor denied further repair services, claiming payment discrepancies, which led our client to spend an additional Ksh. 3,000,000 for repairs elsewhere. The contractor subsequently initiated a lawsuit against our client for Ksh. 4.5 million in alleged outstanding payments.

Solution: The cornerstone of our strategy was an in-depth legal analysis of the contractual commitments and violations. I conducted a meticulous review of the contract documents and relevant legal precedents to outline a negotiation strategy that would bypass the courts.

​

Implementation: Armed with substantial legal findings, I facilitated multiple negotiation meetings focusing on the evidence of contractual adherence and financial transactions. The dialogue was constructed around our robust legal research, aiming to clarify misunderstandings and foster a mutual resolution.

Impact: This informed approach allowed us to avert litigation, saving the client an estimated Ksh. 5,000,000 in potential legal expenses and court fees. The dispute was resolved in favor of our client, maintaining their industry reputation and upholding the integrity of their business relationships.

Our research-driven negotiation strategy led to an equitable resolution, avoiding costly litigation. Additionally, our readiness for legal action ensured a robust defense, highlighting our commitment to protecting Victory Farm's interests. These efforts showcased the effectiveness of our comprehensive strategy in managing the dispute.

Success Factors: Key to our success was the comprehensive legal audit and the strategic use of alternative dispute resolution methods. These efforts were supported by extensive research comparing action plans in Kenya and the Netherlands, which informed our negotiation and legal strategies.
